We are pleased to inform you that long pending implementation of the new trademark acti.e. The Trademark Act, 1999 with The Trademark Rules 2002 have beenimplemented with effect from 15th Sept 2003.
Some of the Salient Features of the above Act areas follows:
1. It provides registration of trademarks for services besides goods.
2. It also provides for registration of "collective marks" owned byassociation, etc.
3. Establishment of appellate board known as "Intellectual PropertyAppellate Board" for speedy disposal of appeals and rectification ofapplications, which at present lie before the High Court
4. Punishment enhanced on part with the present Copyright Act, 1957 for theoffences relating to trademarks to prevent the sale of spurious goods.
5. Application of convention country to include other countries that aremembers of group of Union of countries andinter governmental organization extended. Use of someone else's trademark as part of corporate name or name of business concern prohibited.
6. The definition of "Trademark" amended incorporating in it "Collectivemark" or "certification trade mark".
7. It made provisions for filling single application for registration oftrademarks and increased the period of registration and renewal from 7 to 10years.
8. Trademarks offences are made cognizable under jurisdiction of Courtsenlarged to bring the law on par with copyright law.
